Prejudice to the effective conduct of public affairs (section 36 FOIA)
In the reasonable opinion of the Chair of Trustees, (the qualified person for the purpose of the FOIA), disclosure of some of the information you have requested:
- would, or would be likely to, inhibit the free and frank exchange of views for the purposes of deliberation (s36(2)(b)(ii)FOIA); and
- would otherwise prejudice, or would be likely otherwise to prejudice, the effective conduct of public affairs (s36(2)(c) FOIA).
Disclosure of the withheld information would have the effect of inhibiting the exchange of views in such a way that it would inhibit the ability of trustees to express themselves openly, honestly and completely when providing giving their views as part of the process of deliberation.
Inhibiting the exchange of views in this way would impair the quality of decision-making by the trustees, insofar as trustees would be likely to feel inhibited in relation to what they could and could not say. This would have the impact of adversely affecting the quality of oversight provided by trustees, and record-keeping of that oversight going forwards.
Additionally, information has been withheld so as to avoid further prejudice to the effective conduct of public affairs. Disclosure would be likely to affect the School’s ability to discharge its responsibilities to students, parents and staff. This could be particularly detrimental given the demanding nature of the processes necessary to ensure the smooth closure of the School.
These are qualified exemptions and are subject to the public interest test.
